The California Department of Toxic Substances Control (DTSC) has published a draft regulation related to safer consumer product alternatives. The DTSC and the Green Ribbon Science Panel have been working to create this draft regulation for several months in accordance with the requirement of the California Green Chemistry Initiative. The draft outlines the requirements and criteria for the DTSC to create a list of “Chemicals under Consideration” (CUC) and, subsequently, a list of “Chemicals of Concern” (COC). In addition to the chemicals, the DTSC will prepare a list of priority products to be assessed. The document outlines how it is determined that these chemicals and products will be candidates for the lists.
The draft regulation also provides the requirements for companies to notify DTSC that they manufactured a chemical or product that is included on the lists. It explains the steps for performing an alternatives assessment, how regulatory response will be handled, and administrative information related to the assessment, such as confidentiality of posted information.
